Terms and conditions of use
The Terms of Use (hereinafter defined), together with the Privacy Policy (hereinafter defined) (the “Agreement”), constitute the entire Agreement between E2 Immobilier. (hereinafter referred to as “E2 Immobilier”) and the user of the Site (hereinafter referred to as the “User”) with respect to the terms and conditions of use of the E2immobilier.com website (the “Site”) and all Site content operated by E2 Immobilier. The Agreement is for an indefinite term and takes effect upon the User’s access to the Site.
The user acknowledges that he/she understands and accepts all the terms and conditions of use of the Site (hereinafter referred to as the “Conditions”) reproduced in the Agreement. The Terms may be modified by E2 Immobilier at its discretion and without prior notice. The user is invited to reread the Terms of Use from time to time to take note of any changes.
The user agrees that all communications with E2 Immobilier may be made electronically.

In order to provide users with as much information as possible, E2 Immobilier may need to call upon the services of third parties. E2 Immobilier therefore assumes no responsibility for, and makes no representations or warranties as to, the timeliness, accuracy or completeness of any information provided by such third parties. Any hyperlink from the Site to another Internet site should not be construed as an endorsement by E2 Immobilier of the content of that site, and E2 Immobilier disclaims all liability with respect to such other sites and any information that may be presented therein.

The Site is the official E2 Immobilier site. No other Internet site claiming to represent E2 Immobilier is authorized and E2 Immobilier cannot be held responsible in any way for any other Web site.
The content of the Site is provided for information purposes only and does not constitute sufficient information on which to base transactions and/or decisions of any kind. The information presented on the Site cannot replace the advice of any professional.
E2 Immobilier makes no warranty as to the availability of the Site and reserves the right to terminate the Site or to modify, suspend or discontinue any aspect of the Site at any time at its discretion, without notice. E2 Immobilier reserves the right to deny access to the Site to any user, without notice and without having to provide any justification. E2 Immobilier may monitor use of and access to the Site. This Site is accessible “as is” and at the time it is available and may not be modified by the user.
Where permitted by law, E2 Immobilier shall not be liable for any loss or inconvenience suffered as a result of the termination, modification, suspension or deletion of the Site, in whole or in part.
PROHIBITED USE OF THE SITE
The user must not, in particular, but without limiting the generality of the following, include or copy the Site or any part of the Site in any other Web site that it creates or distributes, use the Site in such a way as to damage it, put it out of service, compromise its security or the security of any provider who may host it or the latter’s equipment, transmit computer viruses, Trojan horses or any other type of malicious software that could disrupt, destroy or place an unreasonable load on the Site’s infrastructure, use the Site or its content in such a way as to infringe the rights of a third party (property rights or otherwise), use the Site in a manner that would be illegal in the user’s territory, include content on the Site that would be indecent, offensive, intimidating, vexatious, defamatory, fraudulent, deceptive, threatening, vulgar, pornographic or explicitly sexual, include content on the Site that would encourage a user to include prohibited content, disclose a person’s personal information or images without that person’s authorization, use the Site to collect personal information from its users (including e-mail addresses) without their consent, use the Site for commercial purposes other than those to be agreed upon with E2 Immobilier. (in particular offering to sell goods or services, soliciting other users of the Site for any reason whatsoever, commercial or otherwise) or producing a mirror image of the Site.

All names, logos and designs related to E2 Immobilier displayed on the Site are trademarks, registered or not, and are the exclusive property of E2 Immobilier.
The Site and all its contents are protected by copyright. All content appearing on the Site (including titles, logos, icons, graphics, designs and other content) is the exclusive property of E2 Immobilier or its suppliers and is protected by Canadian and international copyright laws. The user may not, without the written consent of E2 Immobilier, reproduce, copy, publish, communicate or use in any way the material, information and/or trademarks displayed on the Site. You are granted a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to copy, download, display on your computer, print and use the contents of the Site for informational purposes only, and only for your personal use.
PRODUCTS
E2 Immobilier wishes to provide the most accurate and complete information concerning the products it sells. However, E2 Immobilier does not warrant that the description of products sold or any other content of the Site is accurate, complete, reliable, current or error-free. No information contained on the Site may be interpreted by the user as being an endorsement of such products by E2 Immobilier nor as constituting an association between E2 Immobilier and any product. Verification by the user on the Centris.ca website is necessary to confirm any information.
To the extent permitted by law, E2 Immobilier shall not be liable for the use of such products by the user to prevent, diagnose or treat a particular medical condition.

3D visuals, virtual tours and photos are for information purposes only. Construction will be based on approved and signed plans.
PRICING POLICY
Prices and product availability are subject to change without notice. Although E2 Immobilier makes every effort to avoid pricing errors on the Site, typographical or illustrative pricing errors may occur. E2 Immobilier reserves the right to make any necessary corrections and cannot be held responsible for such errors.
All prices displayed on the Site are in Canadian dollars, unless otherwise indicated.
CONFIDENTIALITY AND PRIVACY
The user agrees and consents that any material, information or intelligence sent to E2 Immobilier through the Site shall become the exclusive property of E2 Immobilier and further agrees that E2 Immobilier may use any such information in accordance with its Privacy Policy. The user understands and agrees that he/she may not assert any ownership rights whatsoever in such material, information or intelligence. The user hereby waives all moral rights in favor of E2 Immobilier as well as the right to receive any consideration in money or other compensation.
E2 Immobilier may use the user’s contact information and any information collected through the Site in accordance with its Privacy Policy, which forms an integral part of the Terms of Use.
E2 Immobilier makes no representations or warranties as to the confidentiality of any information transmitted over the Internet, by e-mail and/or by any other means of communication.
NON-LIABILITY
The Site and the elements it contains are provided as is and according to their availability. E2 Immobilier makes no representations or warranties of any kind, express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Subject to any applicable laws of public order and limitation to the contrary, E2 Immobilier cannot be held responsible and makes no warranties, including warranties of merchantability and/or fitness for a particular purpose. Furthermore, E2 Immobilier makes no representations regarding the use, validity, accuracy or reliability of the materials reproduced on the Site or as to the results to be obtained from the use of such materials. Although E2 Immobilier makes every effort to ensure that the Site is error-free, E2 Immobilier assumes no responsibility for any errors that may appear. E2 Immobilier does not guarantee the absence of viruses or other harmful components on the Site, its servers or via e-mail from E2 Immobilier. In no event shall E2 Immobilier, its officers, employees, representatives or agents be liable for any damages related directly or indirectly to the use of the Site, including any loss of data or profit arising out of the use of or inability to use the materials on the Site.
E2 Immobilier shall not be liable for any damages and/or claims arising from misuse, abuse, modification, improper product selection or misappropriation.
If the user suffers any prejudice or disagrees in any way whatsoever with the Terms of Use, the user is invited to leave the Site without delay.
APPLICABLE LAWS
The Agreement and the content of the Site are governed by the laws of Quebec and the federal laws applicable in Quebec, and any dispute in this regard shall be submitted to a court of competent jurisdiction in the judicial district of Longueuil to the exclusion of all others.
In the event that any particular provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, such invalidity shall not in any way affect the intent or scope of these Terms of Use, all other provisions of which shall remain in full force and effect.
E2 Immobilier’s failure to exercise any of its rights shall not be construed as an express or implied waiver by E2 Immobilier of any future exercise of such right or of any other right under these Terms of Use.
